Motor vehicle - Impaired driving - Breathalyzer - Refusal to provide breath sample - Reasonable excuse - What constitutes - Criminal Code of Canada, R.S.C. 1970, c. C-34, s. 235(2) - The Prince Edward Island Supreme Court held that the accused was properly convicted for refusal, where he refused to take a breathalyzer test which could not be completed within the two hour time limit - The Supreme Court held that it was not a reasonable excuse for refusal that there was insufficient time to complete the provision and analysis of two breath samples within the two hour time limit.
