The Crown appealed an accused young offender's acquittal of an offence under s. 127(2)(a) of the Highway Traffic Act (excessive noise or squealing tires).

The Prince Edward Island Supreme Court, Trial Division, allowed the appeal.

Right to counsel - Entitlement - Provincial offences - Sections 11 and 56 of the feder­al Young Offenders Act addressed an accused young offender's right to retain counsel upon arrest or detention and the admissibility of evidence - The Prince Edward Island Supreme Court, Trial Divi­sion, noted that ss. 11 and 56 were grounded in the protections for the rights of an accused provided by the Charter - The court held that ss. 11 and 56 were not applicable to a prosecution under the Young Offenders (P.E.I.)
