Summary:

The Crown appealed the accused's acquittal of fishing during close time. The Atlantic Close Time Variation Order, 1986 - 117, purported to alter close time in 1986. The trial judge held that the order was not valid because it was not signed by a person authorized by regulation to make the variation.

The Nova Scotia County Court dismissed the appeal.
