Stanley Wereschuk won $500,000 in a lottery one year after separating from his wife. He failed to mention the win in divorce proceedings over the next several years. When his windfall came to light after the divorce was final, his ex-wife went back to court claiming an interest in the money; she succeeded at trial. Mr Wereschuk appealed maintaining that lottery windfalls are exempt from matrimonial property proceedings. The Alberta Court of Appeal concluded that lottery winnings are matrimonial property.
