Summary:

An owner held back monies owing under a building contract, including statutory holdback under the Builders Lien Act (BLA). The contractor became bankrupt. Subcontractors claimed under the BLA and filed liens against the land. Pursuant to a court order, the owner paid the monies owing into court and the liens were vacated. The bankruptcy trustee applied for an order determining entitlement to the monies paid into court.

The Saskatchewan Court of Queen's Bench held that the monies paid into court, to the extent of the lien claims, were not property of the bankrupt. Alternatively, ss. 56(1), 56(2) and 56(6) of the BLA were not in operational conflict with the Bankruptcy and Insolvency Act and the money paid into court should be paid out in accordance with the BLA.

Creditors - General - Priorities - Statutory liens and charges - Force and effect of - The Saskatchewan Court of Queen's Bench stated that "Where an application has been made to vacate the lien under s. 56(6) of the BLA [Builders' Lien Act], the effect of the order is that the lien is not discharged, it merely causes it to cease to attach to the land, holdback and contract amount and attaches instead to the money paid into Court. In other words, the effect of the order is that once the liens are vacated a charge is created by virtue of s. 56(6) of the BLA and therefore the money is subject to a security interest in favour of the lien claimants. By virtue of s. 136 of the BIA [Bankruptcy and Insolvency Act] once a lien has been established the property is not subject to distribution." - See paragraph 24.
