Summary:

The Registrar of Motor Vehicles revoked Acker's driver's licence and indefinitely suspended his driving privileges. Acker applied to set aside the decision.

The New Brunswick Court of Queen's Bench, Trial Division, in a judgment not reported in this series of reports, dismissed the application. Acker appealed.

The New Brunswick Court of Appeal allowed the appeal, set aside the Registrar's decision and ordered the Registrar to issue Acker a current driver's licence.

Natural justice - Duty of fairness - Pro­cedural fairness - What constitutes - The Registrar of Motor Vehicles received an R.C.M.P. report questioning Acker's driv­ing ability - The Motor Vehicle Act (s. 309) empowered the Registrar to order Acker to undergo an examination where there was "good cause" to believe he was unqualified - The Registrar notified Acker that his ability to drive was questioned because of his health and to submit to a medical examination and a driver's test - Acker passed the medical but failed the driver's test - Acker's licence was revoked - The New Brunswick Court of Appeal stated that the Registrar had good cause to require a medical, but not a driver's test - Procedural fairness required that Acker be informed of the intended action and be given an opportunity to be heard - The court set aside the revocation.
