APPELLATE ADVOCACY
My late partner and the former Attorney General Ian Scott
hated trials. They were unpredictable. A witness might well say
anything despite exhaustive preparation. Ian preferred judicial
reviews and appeals, where the record is available and the evidence
is immutable. Meanwhile, I keep seeking an answer to the question,
“What persuades?” To answer the question, we have reections by two
esteemed jurists and two formidable advocates. To get there, as Justice
Coulter Osborne famously put it, you must show that your client occupies
the “moral high ground.”
