Summary:
The plaintiff suffered soft tissue injuries when the defendant's vehicle struck her vehicle, as the plaintiff was making a left hand turn. The plaintiff sued the defendant for damages. Liability and damages were both in issue.
The New Brunswick Court of Queen's Bench, Trial Division, in a decision reported at 240 N.B.R.(2d) 384; 622 A.P.R. 384, held that the defendant was entirely at fault for the accident. The court found that the plaintiff was in the intersection and had almost completed her turn when the defendant exited a parking lot and suddenly appeared in the immediate area where the plaintiff was making her turn. The court assessed damages. The defendant appealed the finding of liability.
The New Brunswick Court of Appeal dismissed the appeal.
