Summary:

The plaintiff suffered soft tissue injuries when the defendant's vehicle struck her vehicle, as the plaintiff was making a left hand turn. The plaintiff sued the defendant for damages. Liability and damages were both in issue.

The New Brunswick Court of Queen's Bench, Trial Division, in a decision reported at 240 N.B.R.(2d) 384; 622 A.P.R. 384, held that the defendant was entirely at fault for the accident. The court found that the plain­tiff was in the intersection and had almost completed her turn when the defendant exited a parking lot and suddenly appeared in the immediate area where the plaintiff was making her turn. The court assessed dam­ages. The defendant appealed the finding of liability.

The New Brunswick Court of Appeal dismissed the appeal.
