Summary:

This case arose out of a claim for damages for the wrongful conversion of rock stockpiled at a quarry. The plaintiff was granted the right to extract rock from a dolomite quarry. The plaintiff's right to extract the rock was terminated at a time when the plaintiff had stockpiled at the quarry 7,089 tons of material. The defendant removed the stockpiled material from the quarry without the plaintiff's permission. The Trial Division allowed the plaintiff's action and awarded the plaintiff $14,006, damages plus $2,000. exemplary damages. The judgment of the Trial Division dated September 3, 1974, is not reported in this series of reports.

On appeal to the Appeal Division of the Nova Scotia Supreme Court the $2,000. exemplary damage award was set aside but the judgment of the Trial Division was otherwise affirmed. The Appeal Division stated that the plaintiff's right to extract rock from the quarry was an interest in land and that the provisions of the Sale of Goods Act were not applicable. The Appeal Division held that the stockpiled material became the plaintiff's property the moment that it was severed from the soil regardless of any provisions for payment.

MacKeigan, C.J.N.S., dissenting in the Appeal Division, would have reduced the plaintiff's damage award to $356. MacKeigan, C.J.N.S. stated that the stockpiled material was subject to the provisions of the Sale of Goods Act and that, except with respect to 89 tons of armour stone, the property or title to the stockpiled material did not pass to the plaintiff. MacKeigan, C.J.N.S., stated that the title to the stockpiled material did not pass to the plaintiff because the material was not 'unconditionally appropriated to the contract' within the meaning of rule 5(1) of s. 20 of the Sale of Goods Act - see paragraphs 52 and 53.
