British Columbia Court of Appeal

Finch, C.J.B.C., Hall and Hinkson, JJ.A.

January 31, 2012.

Summary:

At the time that Atwal made an assignment in bankruptcy, he owned a motor vehicle having a value of $5,800. Burnyeat, J., refused to declare that Atwal was entitled to a $5,000 personal exemption for his motor vehicle pursuant to ss. 37 and 67(1)(b) of the Bankruptcy and Insolvency Act (BIA), ss. 71(1)(c), 71.2(2)(b), 71.2(3) of the Court Order Enforcement Act, and s. 2(b) of the Court Order Enforcement Exemption Regulation (see [2011] B.C.T.C. Uned. 687). Atwal appealed.

The British Columbia Court of Appeal allowed the appeal and declared that Atwal was entitled to a personal exemption of $5,000 for his motor vehicle.
