Summary:
The applicants applied for four building permits. The Chief Building Official (CBO) of a city issued conditional building permits requiring the repair or replacement of a defective gabion wall on the property. The applicants applied to overturn the CBO's decision.
The Ontario Superior Court allowed the application and ordered that the building permits be granted unconditionally. The city appealed.
The Ontario Divisional Court allowed the appeal and rescinded the trial judge's order.

Land use control - Building or development permits - Right to issue of - The applicants applied for four building permits for the second phase of a development - The Chief Building Official (CBO) of a city issued conditional building permits requiring the repair or replacement of a defective gabion wall designed to protect a creek bank from erosion - The applicants applied to overturn the CBO's decision - The trial judge allowed the application and ordered that the building permits be granted unconditionally - The city appealed, arguing that the CBO issued the conditional permits properly and lawfully in an attempt to ensure compliance with the owner's continuing obligations in a 1989 site plan agreement, a 1998 amended development agreement and site plan and s. 41 of the Planning Act - The Ontario Divisional Court allowed the city's appeal and rescinded the trial judge's order - The owner had an ongoing obligation respecting maintenance of the property, including the gabion wall - The CBO properly and lawfully issued the permits in accordance with the legislation and the community interest.
