Summary:

S.A. was a dependant adult. The plaintiffs were his court appointed trustees. The plaintiffs sued the defendants. The defendants applied under rule 129(1)(a) of the Rules of Court to strike out certain paragraphs of the statement of claim on the ground that those paragraphs disclosed no cause of action because an individual's last will and testament could not be adjudicated upon while that individual was alive.

The Alberta Court of Queen's Bench allowed the application and struck the impugned paragraphs.
