Résumé:

This case arose out of the plaintiffs' action in negligence against the defendants for damages arising out of a motor vehicle accident in which the plaintiffs, as pedestrians, were run down by the defendants' motor vehicle. Liability was admitted and in the judgment below Stratton, J., of the New Brunswick Court of Queen's Bench, assessed the plaintiffs' damages for personal injuries.

Personal injuries and death - Leg injuries - Displaced fracture of shaft of femur and undisplaced fracture of acetabulum of pelvis - Shock - Open reduction of femur with insertion of Kuntchner nail which was later removed - One month hospitalization - 5 cm. scar on buttock and 45 cm. scar on thigh - Good recovery with residual headaches and back pain - 15 year old boy - The New Brunswick Court of Queen's Bench, awarded $10,000.00 general damages for personal injuries - See paragraphs 2 to 12.

J-2, s. 45 - The plaintiffs in an action in negligence for damages for personal injuries claimed interest on their damages from the date of the accident to the date of judgment over 4 years later - The action could have been tried sooner than it was and was brought on for trial by the defendants - The New Brunswick Court of Queen's Bench, awarded the plaintiffs 7% interest on their damages for 2 years - See paragraph 23.
