Summary:
An alien claimed refugee status. An adjudicator determined that he was not eligible for refugee status because he was a foreign national who, after being denied refugee status and leaving the country, returned before ninety days expired and renewed his application. The alien applied to quash the adjudicator's decision.
The Federal Court of Appeal, dismissed the application.
Aliens - Topic 1329
Admission - Refugees - Right to hearing - The Immigration Act, ss. 46.01(1)(c) and 46.01(5), together provided that a foreign national who was denied refugee status and left Canada, was not eligible to renew his claim if he returned before ninety days expired - An alien argued that these sections were contrary to s. 7 of the Charter (i.e., contrary to the principles of fundamental justice because they denied a returning alien a hearing etc. as required by Singh v. Minister of Employment and Immigration, 58 N.R. 1 (S.C.C.)) - The Federal Court of Appeal affirmed that the Immigration Act provisions were not contrary to s. 7 of the Charter.
