British Columbia Supreme Court

New Westminster

Martinson, J.

January 21, 1999.

Summary:

A father applied for, inter alia, a variation of child support and cancellation of arrears. He submitted that he had married, had a one year old child and two step children and his present responsibilities made it impossible for him to pay the arrears.

The British Columbia Supreme Court summarized the basic principles applicable to variation of support and cancellation of arrears. The court declined to cancel the father's arrears.
