Summary:

The applicant bank applied summarily in chambers by affidavit for an order for removal and sale of an airplane. The respondent applied similarly for an order directing that the seizure of the airplane be released.

A Master of the Alberta Court of Queen's Bench dismissed both applications. The court exercised its discretion under s. 29(8) of the Seizures Act, R.S.A. 1970, c. 338 and ordered that the matter go to trial.
