A defendant sought leave to amend his statement of defence. The plaintiff opposed the amendment on the basis that it would be prejudiced.
The New Brunswick Court of Queen's Bench, Trial Division, allowed the motion in part. The defendant was allowed to amend his defence in part but was not allowed to withdraw an admission.

Pleadings - Amendment of pleadings - Prejudice or presumed prejudice - What constitutes - The plaintiff trustee in bankruptcy sued the defendant for the sale proceeds of a piece of equipment - The defendant sought leave to amend his statement of defence - The amendment, inter alia, had the effect of withdrawing an admission in the statement of defence that the defendant owned the equipment and alleged that the equipment had been owned by a corporation (FotoExpert Inc.) - The New Brunswick Court of Queen's Bench, Trial Division, refused to allow this amendment as the plaintiff would be prejudiced - If the amendment was allowed, the plaintiff's action and the steps taken to date would have been wasted and the plaintiff would be required to commence a new action - As well, FotoExpert Inc. no longer existed.
