The 15 year old defendant took his father's truck without his permission. The 13 year old plaintiff fell out of the truck's cab while the defendant was backing up. He rolled over her head. The plaintiff sued the defen­dant and his father (the vehicle owner) for damages. Liability was in issue.

The New Brunswick Court of Queen's Bench, Trial Division, dismissed the plain­tiff's action.
