Résumé:

The wife in a divorce proceeding moved for an order requiring the husband to disclose certain financial information.

The New Brunswick Court of Queen's Bench, Family Division, in a judgment unreported in this series, dismissed the motion. The wife appealed.

The New Brunswick Court of Appeal allowed the appeal. The court remitted the matter to the motion judge for a proper determination of documents to be disclosed under rule 72.14 of the Rules of Court (N.B.) and s. 21 of the Federal Child Support Guidelines.

Husband and wife - Marital property - Distribution orders - Practice - Financial disclosure (incl. assets and their value) - The wife's petition for divorce contained a claim for child support, spousal support and division of property - Respecting financial disclosure, the New Brunswick Court of Appeal ruled as follows: (1) the respondent husband had a duty to disclose and produce the income information required by his statutory obligations under rule 72.14(1)(a) of the Rules of Court (N.B.) and s. 21 of the Federal Child Support Guidelines; (2) the wife was entitled to seek an order for the enforcement of disclosure under rule 72.14(5) of the Rules and s. 22(1) of the Guidelines; (3) the motion judge's task was to determine whether the documentary evidence sought was relevant and, if so, determine whether it had been produced and, if not, order production - In the present case, the motion judge failed to make the above determinations - The court returned the matter to the motion judge for a proper determination.
