Résumé:

This case arose out of an assessment of $610,150.00 on a salmon fishing property on the Southwest Miramichi River. The property had a river frontage of approximately 2 miles and contained 480 acres. The taxpayer appealed the assessment to the New Brunswick Appeals Tribunal. The Appeals Tribunal reduced the taxpayer's assessment from $610,150.00 to $277,100.00. The taxpayer appealed to the New Brunswick Court of Appeal.

The New Brunswick Court of Appeal set aside the Appeals Tribunal's valuation because it was not supported by the evidence. The Court of Appeal reduced the assessment to $132,000.00 based on expert testimony offered by the taxpayer before the Appeals Tribunal.

Valuation - Evidence and proof - Requirement of evidence to support valuation - The New Brunswick Court of Appeal set aside an assessment valuation made by the New Brunswick Appeals Tribunal - The Court of Appeal stated that there was little or no evidence before the tribunal to support the tribunal's valuation (see paragraph 12).
