The City of Campbellton applied under s. 94 of the Community Planning Act to restrain rock quarry operators from operating a stone crusher on property within the city limits contrary to its zoning bylaw.
The New Brunswick Court of Queen's Bench, Trial Division, allowed the application.

Land use control - Exemptions - Nonconforming use - Change of - The City of Campbellton applied under s. 94 of the Community Planning Act to restrain rock quarry operators from operating a stone crusher within the city limits contrary to a zoning bylaw - The crusher had not been previously used - The quarry operated seasonally and was a prior nonconforming use - The New Brunswick Court of Queen's Bench, Trial Division, concluded that the stone crusher would cause more continuous noise, dust, traffic and usage of existing machinery - The court concluded that the difference in noise and dust were changes of substance and ordered the stone crushing operation to cease.
