Summary:

After initially being turned down for a survivor's pension under the Canada Pension Plan, Pelland was found to be eligible by a Review Tribunal. The Minister of Human Resources and Skills Development sought leave to appeal the Review Tribunal's decision. A member of the Pension Appeal Board (PAB) denied the Minister's request. The Minister applied for judicial review.

The Federal Court allowed the application, holding that the PAB member applied the wrong legal test for deciding an application for leave to appeal. The case was remitted to another member of the PAB to decide the leave application according to the proper test.
