The plaintiff company, as owner of a tractor-trailer, sued the defendant driver for damages suffered to the tractor-trailer in a motor vehicle collision.

The New Brunswick Court of Queen's Bench, Trial Division, allowed the owner's action.

Negligence - Motor vehicle - Standard of care of driver - Imminent danger - "Agony of collision" - On a three lane highway, a car driver moved into the middle or passing lane - A powerful tractor-trailer with no load pulled out from the right lane into the passing lane ahead of the driver, who swerved to the left lane and collided with the plaintiff's oncoming truck - The New Brunswick Court of Queen's Bench, Trial Division, held that the car driver was negligent in failing to pay attention, failing to keep a proper lookout and failing to take ordinary corrective measures, and was solely at fault - See paragraphs 1, 12 to 22.
