Summary:

The parties presented a stated case to answer the following question: whether the Public Purchasing Act (N.B.) and its Regula­tions applied to the evaluation of a tender "for the construction of the structural steel for the Main FGD Building, the Limestone Storage and Grinding Building and the Electrical Building for the Coleson Cove Refurbishment, Coleson Cove Generating Station."

The New Brunswick Court of Queen's Bench, Trial Division, ruled that the Public Purchasing Act and its Regulations did not apply.

Contracts with Crown - Building contracts - Tenders - The New Brunswick Court of Queen's Bench, Trial Division, ruled that the Public Purchasing Act (N.B.) and its Regulations did not apply to the evaluation of a tender "for the construction of the structural steel for the Main FGD Building, the Limestone Storage and Grinding Build­ing and the Electrical Building for the Coleson Cove Refurbishment, Coleson Cove Generating Station" because those legislative provisions dealt with the provi­sion of supplies and services and there was nothing in the definition of supplies and services that gave any suggestion that the words were associated with the construc­tion, repair or alteration of land or struc­tures.
