Summary:

This case arose out of an application by a life tenant for an order to permit a mortgage loan on security of the fee simple in the property for the purpose of making capital improvements. The remainderman opposed the life tenant's application and applied for an order for the sale of the lands. The trial court granted the life tenant's application by ordering that the land vest in the Public Trustee. The trial court dismissed the remainderman's application for an order for sale. The judgment of the trial court is set out below - see paragraphs 56 to 77. The remainderman appealed to the Manitoba Court of Appeal.

The Manitoba Court of Appeal allowed the appeal, set aside the order of the trial court, dismissed the life tenant's application and granted the remainderman an order for the sale of the property.
