Summary:

A wife applied for an annulment of her marriage and in the alternative she sought a decree nisi of divorce. The Alberta Court of Queen's Bench granted a decree nisi and dismissed the application for annulment.

Divorce - Grounds - Separation - Desertion - What constitutes - A woman married a man to help him obtain permanent residence status in Canada in return for $5,000.00 - The parties never lived together - The woman petitioned for a decree nisi on the grounds of desertion under s. 4(1)(e)(ii) of the Divorce Act, R.S.C. 1970, c. D-8 - The Alberta Court of Queen's Bench held that there was no desertion within the meaning of the Act, because the parties separated by consent - See paragraph 21.
