Summary:

A wife applied for an annulment of her marriage and in the alternative she sought a decree nisi of divorce. The Alberta Court of Queen's Bench granted a decree nisi and dismissed the application for annulment.

D-8 - The Alberta Court of Queen's Bench held that there was no desertion within the meaning of the Act, because the parties separated by consent - See paragraph 21.
