Summary:

A business moved to quash a bylaw of the City of Calgary.

The Alberta Court of Queen's Bench quashed the bylaw and in the decision below dealt with several questions with respect to costs.

Costs - Party and party costs - Special orders - Increase in the scale of costs - Rule 605(6) provided that "Unless other­wise ordered ... costs shall be taxed ac­cording to Column 2 of Sched­ule C ... " - The Alberta Court of Queen's Bench stated that the court clearly has a discre­tion to depart from Column 2 of Schedule "C" in the appropriate circum­stances (see para­graph 15).

Costs - Party and party costs - Special orders - Increase in scale of costs, infla­tion - The scale of costs in Schedule "C" of the Rules of Court (Alta.) was enacted in 1984 - The Alberta Court of Queen's Bench took notice of the fact that $1.00 in September 1984 was equal to $1.45 in June of 1993 - The court awarded costs in "column 3, the total fee portion to be multiplied by 1.45" (see paragraphs 29 and 30).
