Summary:
A tobacco farmer brought an action claiming that the federal Excise Act and Excise Tax Act and the provincial Retail Sales Tax Act and Tobacco Tax Act were ultra vires. The farmer claimed government taxation of tobacco violated his equality rights under s. 15 of the Charter and his right to life, liberty and security of the person under s. 7. The farmer claimed entitlement to a monetary damage award under s. 24 of the Charter. The defendants (the Attorneys General of Canada and Ontario) applied to dismiss the action or, alternatively, to determine whether the challenged statutes were ultra vires or violated s. 7 or 15 of the Charter.
Henry, J., of the Ontario Supreme Court, dismissed the defendants' application. The defendants applied for leave to appeal.
Farley, J., of the Ontario Supreme Court, granted leave to appeal respecting ss. 7 and 15, but denied leave to appeal the vires of the statutes. The defendants appealed the refusal to dismiss the action.
The Ontario Divisional Court held that there was no possibility that the s. 7 or 15 arguments could succeed, accordingly, all references to those sections were to be struck from the statement of claim. The farmer's action was accordingly limited to a challenge to the vires of the statutes.

Equality and protection of the law - Taxation - A tobacco farmer claimed the taxation of tobacco products was discriminatory contrary to s. 15 of the Charter - The Ontario Divisional Court stated that the distinction for taxation purposes between different types of products was not discrimination - The court stated that "neither the plaintiff's occupation as a tobacco farmer, nor his participation in the tobacco industry, can be considered a ground of discrimination analogous to the characteristics listed in s. 15(1)" - The court added that "a classification based on occupation is not a personal characteristic ... for the purposes of s. 15(1)" - See paragraphs 28 to 38.
