Husband and wife - Marital property - Distribution orders - Interest on awards - A husband and wife divorced in 1994 - The husband kept the marital home - Accordingly, he had to make an equalization payment to the wife of one-half interest in the home - The wife sought prejudgment interest on her one-half interest - The Alberta Court of Queen's Bench allowed the application - The court stated that the Judgment Interest Act assumed that interest would be paid on money awards - Accordingly, the court's over-riding statutory discretion to refuse prejudgment interest has been restricted by the Court of Appeal to situations that were "compelling" - Here there were no compelling circumstances to disallow the application.
