Summary:

A builder sued Alberta New Home War­ranty Program, claiming that it was not in default of its obligations to home purchasers and, if it was in default, it should have been given notice of default. The Alberta New Home Warranty Program applied to stay the action on the ground that disputes between it and its members were to be settled by arbi­tration.

A Master of the Alberta Court of Queen's Bench allowed the application.

Right to arbitration - What matters arbitrable - Crystal, a builder, was a member of Alberta New Home Warranty Program under a contract containing an arbitration clause - Program determined that Crystal was in default - Crystal sued Program, claiming that it was not in default; if in default, Program completed the houses at too high a cost; Program acted in bad faith; and Program should have given notice and a reasonable time to correct any defaults - Program applied to stay the action on the basis that disputes "in relation to" the contract were to be settled by arbitration - A Master of the Alberta Court of Queen's Bench stayed the action, holding that all of Crystal's com­plaints were in relation to the contract and were, accordingly, arbitrable.
