Guardian and Ward - Topic 855

Public guardian - Termination of guardianship of Children's Aid Society of Cape Breton over a child - Jurisdiction to hear application - Pursuant to the Children's Services Act the Minister of Social Services consented to the commencement of proceedings to terminate the public guardianship of a child - An application was made to the Nova Scotia Supreme Court, Trial Division, and the application was dismissed because of lack of jurisdiction - The Trial Division stated that jurisdiction respecting the termination of guardianship of children who have become public wards rests exclusively, by virtue of the Children's Services Act, with the Nova Scotia Family Court.
