Summary:

Gary and Sandra Gray were injured when their motor vehicle collided with Lang's motor vehicle. They sued Lang for damages for their injuries and, along with their children, brought Family Law Act claims. Sandra Gray also sued her insurer, seeking a declaration of entitlement to continuing weekly benefits and housekeeping expenses.

The Ontario Court (General Division), in a decision reported at 28 O.T.C. 161, allowed the action and assessed damages accordingly. Lang appealed.

The Ontario Court of Appeal dismissed the appeal.
