Summary:

The plaintiff sued a doctor and a hospital for damages alleging that he suffered a permanent loss of balance following the administration of an antibiotic drug (Gen­tamicin).

The Alberta Court of Queen's Bench held that the defendant doctor was negligent and that there was a lack of informed consent. The court assessed damages accordingly.
