Once a valid insurance contract has been created, what are the main
issues concerning the enforcement of this agreement? These issues will
be the subject of Part Three. They fall into six broad categories —
namely, contract interpretation (Chapter 8), settling claims (Chapter
9), valuation of loss (Chapter 10), subrogation (Chapter 11), multiple
coverage (Chapter 12), and third parties (Chapter 13). In the cases
reviewed in this part, the insurer is not contesting the validity of the
agreement. Rather, the insurer is either challenging the contract’s appli-
cation to the facts or attempting to somehow reduce its liability for the
losses suffered by the insured.
