Summary:

Résumé:

An unmarried couple had a child while still attending high school. When the child was approximately two years old, the mother moved from New Brunswick to New Hampshire, U.S.A., with the child. The child's father applied for access. The mother commenced custody proceedings in New Hampshire. A jurisdiction issue arose.

The New Brunswick Court of Queen's Bench, Family Division, held that the access application should be heard in New Bruns­wick. The child was habitually resident in New Brunswick within the meaning of the Family Services Act. This was not a case where the court should decline jurisdiction. The more appropriate jurisdiction was New Brunswick.
