Résumé:

The plaintiff sued the defendant for damages resulting from injuries sustained when the defendant hit his motorcycle. The plaintiff sought advance payment of special damages pursuant to s. 265.6 of the Insurance Act and rule 47.03 of the Rules of Court.

The New Brunswick Court of Queen's Bench, Trial Division, ordered a lump sum advance payment of $10,000 with monthly payments of $2,500 until trial.

Trials - General - Advance payment of damages - The plaintiff sued the defendant for damages resulting from injuries sustained when the defendant turned left and hit the plaintiff's motorcycle which was approaching from the opposite direction and had the right of way - The plaintiff claimed that his injuries prevented him from returning to his job as a heavy equipment operator or any other gainful employment - The plaintiff sought advance payment of special damages (s. 265.6 of the Insurance Act and rule 47.03 of the Rules of Court) - The New Brunswick Court of Queen's Bench, Trial Division, held that advance payments should be made because it was more than 50% certain that the defendant's liability for special damages for past loss of income would be established at trial - Turning to quantum, the court ordered a lump sum advance payment of $10,000 with monthly payments of $2,500 until trial.
