Summary:

This case arose out of a custody contest between two parents respecting their two children, a four year old boy and a six year old girl.

The Saskatchewan Unified Family Court awarded custody of the children to the mother - see 20 Sask.R. 255. The father appealed to the Saskatchewan Court of Appeal.

The Saskatchewan Court of Appeal dismissed the appeal.

Custody of children - Appeals - General principles - The Saskatchewan Court of Appeal stated that a question of custody of a child is a matter which peculiarly lies within the discretion of a trial judge and his decision should not be disturbed on appeal unless he acted on some wrong principle or disregarded material evidence (see paragraph 29).
