Summary:

A company claimed that a bank improperly charged a cheque to the company's account. The cheque was for $20,000 and an employee of the company fraudulently endorsed the cheque with the payee's name. The trial court held that the bank was entitled to charge the cheque to the company's account. The company appealed to the Ontario Court of Appeal. The Ontario Court of Appeal dismissed the appeal. The company appealed to the Supreme Court of Canada. The Supreme Court of Canada dismissed the appeal. Compare Concrete Column v. Royal Bank (1976), 8 N.R. 451 (S.C.C.).
