The plaintiff, a United States citizen, sued a doctor and a hospital for $30,000 under rule 80 of the Rules of Court. The claim concerned her involuntarily admittance to the hospital's psychiatric ward. The defendants each sought security for costs from the plaintiff.

The New Brunswick Court of Queen's Bench, Trial Division, allowed the motions and ordered the plaintiff to pay $1,000 to each defendant as security for costs.

Costs - Security for costs - Where plaintiff resident out of jurisdiction - General - The 74 year old plaintiff, a United States citizen, sued a doctor and a hospital for $30,000 under rule 80 of the Rules of Court - The claim concerned her involuntarily admittance to the hospital's psychiatric ward - The defendants each sought security for costs from the plaintiff on the basis that she resided outside of New Brunswick - She lived six months of the year in Kansas and six months in Nova Scotia (N.S.) - She owned six oceanfront properties in N.S. valued at $500,000 - She had two judgments against her for costs in N.S. - She had a monthly income of $3,000 - She alleged that she was "land poor" and had cash flow problems - The New Brunswick Court of Queen's Bench, Trial Division, allowed the motions and ordered the plaintiff to pay $1,000 to each defendant as security for costs - It was necessary for the administration of justice that a security for costs order pursuant to rule 58 should be available to a defendant in a rule 80 action - The plaintiff was not impecunious - The defendants would be put to considerable expense in recovering their costs outside of New Brunswick against the plaintiff's real property assets in N.S. - The costs order would not constitute a bar to the plaintiff continuing the action.
