Summary:

Zellers assigned its lease in a mall to Arton. The mall brought an action claiming Zellers breached the lease and that it was entitled to terminate the lease and recover possession. The mall applied for an interim injunction to restrain Arton from interfering with its possession of the Zellers premises.

The Nova Scotia Supreme Court, Trial Division, in a judgment not reported in this series of reports, granted the interim injunction. Arton appealed.

The Nova Scotia Supreme Court, Appeal Division, dismissed the appeal.

Interlocutory or interim injunctions - Circumstances when injunction will issue - Zellers assigned its lease in a mall to Arton - The mall claimed Zellers breached the lease and that it was, accordingly, entitled to terminate the lease and recover possession - The mall obtained an interim injunction to restrain Arton from interfering with the mall's use of the Zellers premises pending trial of the action - The trial judge stated that there was "a case which should go forward to trial" and that the balance of convenience favoured granting the injunction where Arton could be compensated in damages, but the mall could not - The Nova Scotia Court of Appeal held that the trial judge did not err in exercising her discretion to grant an interim injunction.
