Summary:

Judge Zaltz of the Provincial Court (Family Division) varied an earlier order of Judge Nowak with respect to child and spousal support. Judge Zaltz's order provided, inter alia, that "paragraph 3 [spousal support] of Judge Nowak's order ... shall be deleted". Two years later, a ruling of Judge Glenn of the Provincial Court (Family Division) allowed for reconsideration and variation of spousal support before the Provincial Court (Family Division). Judge Glenn concluded that the words of Judge Zaltz's order which deleted spousal support merely suspended support and did not terminate it. The husband appealed.

The Ontario Court (General Division) dismissed the appeal.
