ONTARIO REGULATION 211/19

GENERAL

Tribunals

1. The adjudicative tribunals listed in Schedule 1 to this Regulation are prescribed for the purposes of the definition of “tribunal” in subsection 1 (1) of the Act.

Conflict

2. The following provisions prevail over a provision of the Act in the event of a conflict:

1. Subsections 87 (7) to (10) and section 227 of the Child, Youth and Family Services Act, 2017.

2. Subsections 29 (17) and (18) and 38 (4) and (5) and sections 68 and 69 of the Colleges Collective Bargaining Act, 2008.

3. Subsection 123 (2) of the Employment Standards Act, 2000.

4. Subsection 116 (1) of the Environmental Bill of Rights, 1993, in respect of the application of the provisions of the Labour Relations Act, 1995 set out in paragraph 7.

5. Subsection 174 (14) of the Environmental Protection Act, in respect of the application of the provisions of the Labour Relations Act, 1995 set out in paragraph 7.

6. The provisions of any regulation made under section 16 of the Financial Services Tribunal Act, 2017.

7. Subsections 7 (13) and 63 (4) and section 119 of the Labour Relations Act, 1995.

8. Subsection 20 (2) and clauses 63 (1) (c) and (f) of the Occupational Health and Safety Act.

9. Subsection 21 (3) of the Ontario Provincial Police Collective Bargaining Act, 2006, in respect of the application of section 119 of the Labour Relations Act, 1995.

10. Subsection 32 (4) of the Pay Equity Act.

Note: On the day subsection 18 (2) of the Pay Transparency Act, 2018 comes into force, section 2 of the Regulation is amended by adding the following paragraph: (See: O. Reg. 211/19, s. 3)

10.1 Subsection 18 (2) of the Pay Transparency Act, 2018.

11. Subsection 99 (1) of the Provincial Offences Act.

12. Subsection 4 (1) of the School Boards Collective Bargaining Act, 2014, in respect of the application of the provisions of the Labour Relations Act, 1995 set out in paragraph 7.

3. Omitted (provides for amendments to this Regulation).

4. Omitted (provides for coming into force of provisions of this Regulation).
