Summary:

The plaintiff had unprotected sex with three women. He became infected with type 2 herpes simplex virus which, in turn, caused transverse myelitis (inflammation of the spinal cord) resulting in his total paralysis from the mid-abdomen down. The plaintiff sought indemnification from his group insurer for paraplegia caused "directly and independently of all other causes from bodily injuries occasioned solely through external, violent and accidental means". A special case was brought.

The British Columbia Supreme Court, in a decision reported [2007] B.C.T.C. Uned. E08, ruled in favour of the plaintiff. The insurer appealed.

The British Columbia Court of Appeal, in a decision reported 254 B.C.A.C. 120; 426 W.A.C. 120, dismissed the appeal. The insurer appealed.

The Supreme Court of Canada allowed the appeal.

Accident and sickness insurance - The contract - Interpretation of terms - Accident defined - The Supreme Court of Canada stated that "A century and a half of insurance litigation has failed to produce a bright line definition of the word 'accident'" - The court examined the caselaw and then discussed general principles of interpretation - The court held as follows: (1) words like "accident" should be given their ordinary meaning; (2) a generous interpretation should be given to the term "accident" unless a policy clearly restricted it; (3) the words of an insurance contract, when ambiguous, should be construed against the drafter (i.e. the insurer) (contra proferentem); (4) when a policy was ambiguous, effect should be given to the reasonable expectations of the parties; and (5) courts were "normally ... reluctant to depart from [authoritative] judicial precedent interpreting the policy in a particular way" - The court also discussed how the concepts of accident, disease and natural causes related to one another, the expectation test, the happening of disease in the ordinary course of events, disease-based claims and the natural transmission of disease - See paragraphs 16 to 34, 40 to 47, 58 to 66.

Accident and sickness insurance - The contract - Interpretation of terms - Loss resulting directly or independently of other causes from accidental bodily injuries - The plaintiff had unprotected sex with three women - He became infected with type 2 herpes simplex virus (HSV-2) which, in turn, caused transverse myelitis (inflammation of the spinal cord) resulting in his total paralysis from the mid-abdomen down - The plaintiff sought indemnification from his group insurer for paraplegia caused "as a direct result of a Critical Disease or resulting directly and independently of all other causes from bodily injuries occasioned solely through external, violent and accidental means" - The list of Critical Disease under the policy did not include sexually transmitted diseases - The Supreme Court of Canada dismissed the claim - The causal chain that led to the plaintiff's bodily injury was sex that transmitted the herpes that led to transverse myelitis - Transverse myelitis was an unexpected consequence of the disease, but it occurred (though rarely) as a normal incident or consequence of that disease - The court did not place emphasis on the fact the sex was unprotected - To conclude that the plaintiff's acquisition of herpes was an "accident" despite the absence of any mishap or trauma other than the acquisition of a sexually transmitted disease in the ordinary way would simply serve to add sexually transmitted diseases to the list of Critical Diseases in the group policy contrary to the intent of the policy - See paragraphs 1 to 67.
