Summary:

The applicants (a mother and her minor child), citizens of Jamaica, claimed refugee protection based on a fear of the mother's ex-boyfriend and the child's father. The Refugee Protection Division of the Immigration and Refugee Board denied the claim. The Refugee Appeal Division (RAD) dismissed the applicants' appeal. The applicants applied for judicial review.

The Federal Court allowed the application and remitted the matter to the RAD for reconsideration.

Admission - Refugee protection, Convention refugees and persons in need of protection - Refugee Protection Division and Refugee Appeal Division - Determination by - Green and her minor child, citizens of Jamaica, claimed refugee protection based on a fear of domestic abuse by Green's ex-boyfriend and the child's father - The Refugee Protection Division (RPD) denied the claim, finding that Green was not completely credible and that state protection would be available to her in Jamaica - The Refugee Appeal Division (RAD) dismissed Green's appeal - Although it found that the RPD's credibility findings were unreasonable, the RAD concluded that the RPD's state protection findings were reasonable - The Federal Court allowed Green's application for judicial review - The RPD's state protection findings were based on its credibility findings - Having found that the credibility findings were unreasonable, there was no basis for the RAD to uphold the RPD's state protection findings - The RAD also erred by performing a judicial review type function rather than an appellate function - It should have conducted an independent assessment of the evidence respecting the adequacy of state protection and Green's efforts to seek state protection.
