Summary:
Guimond was convicted of 34 offences under the Highway Safety Code (Que.) and was fined. He paid a few small fines but left the rest unpaid. Guimond was then sentenced to 346 days in jail. He was released conditionally after 49 days. He moved for judicial authorization under art. 1003 of the Code of Civil Procedure (Que.) to initiate a class action for damages to redress the alleged constitutional invalidity of his detention (and the detention of other members of the class) on the basis that the term of his detention contravened ss. 7, 9 and 12 of the Canadian Charter of Rights and Freedoms and ss. 1, 24 and 25 of the Charter of Human Rights and Freedoms (Que.). Guimond's action sought both a declaration of constitutional invalidity under s. 52 of the Constitution Act, 1982 and compensatory and moral damages under art. 1053 of the Civil Code of Lower Canada and s. 24(1) of the Canadian Charter.
The Quebec Superior Court dismissed Guimond's motion. Guimond appealed.
The Quebec Court of Appeal, Delisle, J.A., dissenting, in a judgment reported [1995] R.J.Q. 380; 123 D.L.R.(4th) 236, allowed the appeal. The Quebec Attorney General appealed.
The Supreme Court of Canada allowed the appeal.

Class action - Authorization to institute class action - Facts alleged seem to justify the conclusions sought - Guimond complained that his jail term (and that of others) for failure to pay fines for traffic offences violated the Quebec and the Canadian Charters - He sought authorization to institute a class action for a declaration of constitutional invalidity and for damages under the Civil Code of Lower Canada and the Canadian Charter - The Supreme Court of Canada affirmed the trial judge's decision to dismiss the motion because of absence of "good colour of right" - The court held that the judge properly exercised his discretion because, as a general rule, an action will not lie "for damages arising from the enactment of laws subsequently determined to be unconstitutional".
