Summary:
The Saskatchewan Court of Queen's Bench made an order distributing matrimonial property under the Matrimonial Property Act - see 15 Sask.R. 13. The husband appealed. The wife cross-appealed.
The Saskatchewan Court of Appeal dismissed the appeal and allowed the cross-appeal.
Family Law - Topic 882
Husband and wife - Considerations in making distribution orders - Relevant considerations - Ownership of land outside the province - A trial judge ordered that matrimonial property be distributed $50,500.00 to the husband and $27,000.00 to the wife - The wife owned land in Alberta worth approximately $200,000.00 - The Saskatchewan Court of Appeal affirmed that it was proper in the circumstances to consider the wife's land in Alberta in making the distribution of the matrimonial property (see paragraph 21).
