Summary:

A farmer purchased a steel building from the defendant supplier. The farmer ordered replacement parts for the steel building from the supplier. The supplier neglected to order the parts for approximately 70 days. The farmer claimed damages for delay.

The Saskatchewan Court of Queens' Bench allowed the farmer's action against the supplier and an employee of the supplier and awarded the farmer damages of $75,000.00. The judgment of the Court of Queen's Bench is reported at 9 Sask.R. 169. The defendants appealed to the Saskatchewan Court of Appeal

The Saskatchewan Court of Appeal allowed the appeal of the defendant employee and set aside the finding of liability against the employee.

The Saskatchewan Court of Appeal dismissed the appeal of the supplier, Sterling Structures Co. Ltd.
