Summary:

In 1987 Walsh was slightly injured and Muir was killed when their vehicle collided with another vehicle. A jury found that the driver of the other vehicle was 100% at fault. Walsh and Muir had a nine month old son, Matthew. Walsh claimed damages for personal injury. Walsh, Matthew, Muir's mother and Muir's two sisters brought Family Law Act claims. Walsh had remarried.

The Ontario Court (General Division), in a decision reported at 37 O.T.C. 161, assessed damages accordingly.

The Ontario Court (General Division) determined issues of prejudgment interest and costs.
