Summary:

This case arose out of an employee's action for damages for wrongful dismissal. The trial judge allowed the employee's action but deducted unemployment insurance benefits of $1,330.00. The employer appealed to the British Columbia Court of Appeal.

The British Columbia Court of Appeal dismissed the employer's appeal but allowed the employee's cross-appeal and held that the unemployment insurance benefits should not be deducted. The employer appealed to the Supreme Court of Canada.

The Supreme Court of Canada dismissed the employer's appeal.
