Summary:
The applicant young offender was sentenced at trial to a term of open custody. She was held in the Castle Unit of the Calgary Young Offender Centre, a facility designated as providing both open and closed custody. She applied for a declaration that the Castle Unit was not an open custody facility, arguing that her custody there was effectively closed custody.
The Alberta Court of Queen's Bench ruled that the Castle Unit was not an open custody facility as defined under the Young Offender's Act, and ordered that the applicant be placed into open custody or released.
